PLACING
ORDERS: An order is not binding upon DCS
Computer Services until it is accepted and payment is cleared. DCS Computer Services must receive
payment before it will accept an order. Payment in full for product(s) ordered
is due upon checkout. Customers can make payments by any of our
available payment methods.
Customer agrees to pay the amount(s) due as specified on the invoice.
No Customer shall institute a Stop Payment. Disputes will be handled exponentially as
governed by the law of the state of Tennessee.
CANCELLATIONS: THE CUSTOMER HAS 48 HOURS
FROM PLACEMENT OF ORDER TO CANCEL.
You, The Customer have 48 hours to cancel your order. No orders may be cancelled once
the order has been processed. If your order is placed on Sunday your
cancellation deadline will extend to Tuesday at 12pm cst.
You MUST Call us at 1-931-837-7117 during our normal hours of operation to request
an order cancellation. You will receive a credit for the full amount to your
credit/debit card in approximately 2-7 business days. We will not process cancellations requested by
email.

SHIPPING CHARGES:
Your total cost for purchase of any product will include shipping and handling
charges shown on the DCS Computer Services invoice.
Items will be shipped using UPS Ground or FEDEX.
PAYMENT METHODS: All payments methods
are accepted through PayPal.
Cash and Checks are accepted via US postal service and in person including cashier's
checks, but will take slightly longer to process because all payments must
first clear with the bank due to the risk of fraudulent checks.)
No Purchase Orders, Fax or C.O.D. orders please.
SALES TAX: Sales tax is only required
for orders purchased or shipped into states where we have or may have nexus for state tax purposes
under applicable laws. Therefore all orders shipping into Tennessee will
be charged applicable sales tax according to your area's tax rate.
Please note that the sales tax for Tennessee orders is calculated based upon the
total price of the order, including shipping and handling. The tax imposed by
these states on shipping and handling is part of the state sales tax, not a separate tax.
DELIVERY: Delivery of your new
computer system will be between 10-14 days of cleared payment.
WARRANTY & RETURN POLICY: Warranties:
All products are warranted by the manufacturer. DCS Computer Services will provide 1
year parts and labor on all custom built systems we ship. Shipping to and from
our facility for such warranty is the sole responsibility of The Customer.
PRODUCTS SOLD BY DCS Computer Services ARE NOT MANUFACTURED BY DCS Computer
Services. THE PRODUCTS MAY, HOWEVER, BE COVERED BY EACH MANUFACTURER'S
WARRANTY, SERVICE, AND SUPPORT POLICY (IF PRESENT). DCS Computer Services ASSIGNS AND PASSES THROUGH TO THE
CUSTOMER ANY WARRANTY OF THE MANUFACTURER, AND CUSTOMER ACKNOWLEDGES THAT IT
SHALL HAVE RECOURSE ONLY UNDER SUCH WARRANTIES AND ONLY AS AGAINST THE MANUFACTURER OF THE PRODUCTS. DCS Computer Services MAKES NO REPRESENTATION OR EXPRESS WARRANTY
WITH RESPECT TO THE PRODUCT EXCEPT THOSE STATED IN THIS DOCUMENT. DCS Computer
Services DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, AS TO ANY SUCH PRODUCT,
INCLUDING AND WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND
FITNESS FOR A PARTICULAR PURPOSE, AND ANY IMPLIED WARRANTIES ARISING FROM
STATUTE, TRADE USAGE, COURSE OF DEALING, OR COURSE OF PERFORMANCE. ALL ITEMS SOLD THROUGH DCS ARE SOLD
"AS-IS" OR "WITH ALL FAULTS." THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF
THESE ITEMS IS WITH THE BUYER. SHOULD ANY OF THESE ITEMS PROVE DEFECTIVE, DO
NOT FUNCTION, OR FUNCTION IMPROPERLY IN ANY WAY FOLLOWING THEIR PURCHASE, THE BUYER, AND NOT THE
MANUFACTURER, DISTRIBUTOR, OR DCS Computer Services, ASSUMES THE ENTIRE COST
OF ALL NECESSARY SERVICING OR REPAIR. IN ALL CIRCUMSTANCES DCS'S MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS SOLD. DCS Computer Services SHALL NOT,
UNDER ANY CIRCUMSTANCES, BE LIABLE
UPON A CLAIM OR ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS
RELATING TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. DCS
Computer Services SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR
MALFUNCTION, DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO
EXEMPLARY DAMAGES, WHETHER OR NOT DCS Computer Services HAS BEEN MADE AWARE OF
THE POSSIBILITY OF SUCH CLAIMS OR DAMAGES.
REFUNDS: ALL SALES ARE FINAL. DCS Computer
Services DOES NOT PROCESS REFUNDS.
If the product is defective; DCS Computer Services, at it's desecration
will repair or replace the component(s) necessary.
Our custom build computers use only top of the line parts by major manufacturers. We
hand assemble each machine and perform quality control testing before it
leaves our facility.
Defective Returns: All systems unless
otherwise indicated may be returned at the customers expense for warranty service. A return authorization
number is required for all returns.
Product Return Procedure: To return a
product for warranty coverage in compliance with DCS Computer Services policy, you must first obtain a Return
Merchandise Authorization ("RMA") number. DCS Computer Services will not
accept returns without prior authorization and a RMA number. Once issued, RMA numbers are valid for 7 days within which return products must be received by DCS
Computer Services. RMA numbers will not be extended or reissued. The
Customer should prominently display the RMA number(s) on the shipping label of boxes containing the
returned product. The Customer is solely responsible for all shipping
charges returned for repair to and from DCS Computer Services. The Customer agrees to use only reputable carriers capable of providing proof of delivery and insurance
for the entire value of the shipment. The
Customer agrees to bear all shipping and insurance charges and all risk of loss for
the return product during shipment. Customer agrees that all returned products
will be 100% complete, in re-saleable condition, and will include the original packaging material, manuals,
blank warranty cards, and other accessories provided by the manufacturer. If any
component of the returned product is missing, DCS
Computer Services' s Return Procedure will be breached and DCS Computer Services may
in its sole and absolute discretion reject the entire return or choose to
impose additional charges against the customer for replacement of the missing component(s).
DCS Computer Services will not refund to The Customer the any shipping charges.
Physical damage to any system or system component purchased from DCS Computer
Services will effectively void all warranty coverage. DCS Computer Services will return any physically
damaged system or component back to the customer at the customer's expense. Return
Shipping Charges: All shipping and insurance to
and from DCS Computer Services for repair or replacement warranties is the sole
responsibility of The Customer.
RISK OF LOSS: DCS Computer Services
will arrange for shipment of ordered product(s) to the Customer, Free On Board (F.O.B.) shipping
point, meaning title to the product(s) -- excepting software-- and risk
of loss passes to the Customer upon delivery to the carrier.
DCS Computer Services reserves a purchase money security interest in the product(s)
until its receipt of the full amount due.
Customer agrees to allow DCS Computer Services to sign appropriate documents on
Customer's behalf to permit DCS Computer Services to protect its purchase
money security interest. Title to software will remain with the licensor(s). All software is provided
subject to the license agreement of the software maker. Customer agrees to be bound
by any software license agreement once the seal on the package is broken. DCS
Computer Services will advise Customer of estimated shipping dates, but DCS Computer Services
will, under no circumstances, be responsible for delays in delivery, and
associated damages, due to events beyond its reasonable control,
including without limitation, acts of God or public enemy, acts of federal, state or local government, fire,
floods, civil disobedience, strikes, lockouts, and freight
embargoes.
LIMITATION OF LIABILITY: IN ALL
CIRCUMSTANCES DCS Computer Service's MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCTS
SOLD.
DCS Computer Services SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE UPON A CLAIM OR
ACTION IN CONTRACT, TORT, INDEMNITY OR CONTRIBUTION, OR OTHER CLAIMS RELATING
TO THE PRODUCTS IT SELLS WHICH EXCEEDS THIS LIABILITY LIMIT. DCS Computer Services SHALL NOT BE LIABLE FOR THIRD PARTY CLAIMS FOR DAMAGES AGAINST THE CUSTOMER, OR FOR MALFUNCTION,
DELAYS, INTERRUPTION OF SERVICE, LOSS OF BUSINESS, LOSS OR DAMAGE TO EXEMPLARY
DAMAGES, WHETHER OR NOT DCS Computer Services HAS BEEN MADE AWARE OF THE
POSSIBILITY OF SUCH CLAIMS OR DAMAGES.
GOVERNING LAW AND JURISDICTION: Any
dispute arising out of or related to these Terms and Conditions or the sales transaction between DCS Computer
Services and Customer shall be governed by the laws of the State of
Tennessee, without regard to its conflicts of law rules. Specifically, the validity, interpretation, and performance of this agreement shall not be governed by
the United Nations Convention on the International Sale of Goods. DCS
Computer Services and Customer consent to the exclusive jurisdiction and the exclusive venue
of the State Courts of the State of Tennessee, White County, to resolve any
dispute between them related hereto, and the parities waive all rights
to contest this exclusive jurisdiction and venue of such Courts. Finally, the Customer also agree not to
bring any legal action, based upon any legal theory including contract,
tort, equity or otherwise, against DCS Computer Services that is more
than one year after the date of the applicable invoice.
SEVERABILITY: If any provision
contained in this agreement is or becomes invalid, illegal, or unenforceable in whole or in part, such
invalidity, illegality, or unenforceable shall not affect the remaining
provisions and portions of this agreement, and the invalid, illegal,
or unenforceable provision shall be deemed modified so as to have the most similar
result that is valid and enforceable under applicable Tennessee
law.
WAIVER: The failure of either party
to require performance by the other party of any provision of this agreement shall not affect in any
way the first party's right to require such performance at any time thereafter.
Any waiver by either party of a breach of any
provision in this agreement shall not be taken or held by the other party to be a
continuing waiver of that provision unless such waiver is made in
writing.
ENTIRE AGREEMENT: These terms and
conditions, together with DCS Computer Services' s invoice regarding the products ordered by Customer, are
the complete and exclusive agreement between DCS Computer Services and
Customer, and they supersede all prior or contemporaneous proposals, oral or written, understandings, representations, conditions, warranties, and all other
communications between DCS Computer Services
and Customer relating to the subject products. This agreement may not be explained or
supplemented by any prior course of dealings or trade by custom or
usage.
Product Descriptions: All orders are
subject to approval and cleared payment. While DCS Computer Services strives for accuracy in all item
descriptions, specifications, pricing, links and any other
product-related information contained or referenced on our website, we cannot guarantee that all item descriptions, photographs, compatibility references, detailed specifications,
pricing, links and any other product-related information listed is
entirely accurate, complete or current, nor can we assume responsibility for these
errors. In the event a product listed on our website is labeled
with an incorrect price due to some typographical, informational, technical or other error, DCS Computer Services shall at its sole discretion have the right to refuse
and/or cancel any order for said product and immediately amend, correct
and/or remove the inaccurate information. Additionally, all hyperlinks to other websites from
DCS Computer Services are provided as resources to customers looking for
additional information and/or professional opinion.
DCS Computer Services does not assume responsibility for the claims and/or
representations made on these or any other websites.
DOA's (Dead On Arrival) are an unavoidable aspect of any business model that
involves direct shipment to customers. Please understand that DCS Computer
Services ships only pre-tested systems after they have been fully tested for functionality,
and boxed products it assumes to be functional and that any defective product you may
have received was either damaged in transit or was anomalous.

without notice.
By default it is understood that if you the client purchase from DCS Computer
Services you have read, understood and agreed to this policy.
